Expertise: Analysis, evaluation and opinion letters on all aspects of title insurance cases and transactions, including, but not limited to: (i) interpretations of coverage and breach of contract, on ALTA & Texas title insurance policy forms and insured closing letters; (ii) liability outside the policy; (iii) escrow liability for closing the transaction; (iv) negligence; (v) fraud; (vi) bad faith; (vii) breach of fiduciary duty; (viii) Texas Deceptive Trade Practices Act; (ix) Racketeer Influenced Corrupt Organizations Act - RICO; (x) Texas Insurance Code Violations; and, (xi) Texas title insurance regulatory interpretations. Assistance on case strategy, effective discovery and exhibit preparation. Expert Witness Services include analysis and evaluation of all aspects of title insurance cases and transactions. We provide assistance in connection with: (i) case "fact" analysis; (ii) case "legal" analysis; (iii) case "regulatory" analysis under the Texas title insurance regulations and Texas Title Insurance Act; (iv) case "business" or "practicality" analysis; (v) development of case strategy; (vi) development of an effective discovery plan; (vii) developing deposition and interrogatory questions; (viii) preparation of trial exhibits and graphics; and, (ix) presentation of expert witness testimony to the jury which simply and clearly explains the relevant aspects of title insurance. We will prepare expert witness reports, or legal opinions on the ultimate issues, as client needs dictate. We attempt to balance our practice between both Plaintiff and Defense oriented work. |
