Description: Portland, OR - Two children sued the Oregon Department of Human Services on negligence theories claiming that DHS failed to exercise due care when it placed them in the care of Kimberly Vollmer. The Plaintiff claimed that they were molested by Vollmer who should not have been approved to provide foster care to them or any other child because of a low IQ and emotional problems.
DHS contended that it counld not have know of the terrible abuses taking place in Vollmer's home.
Vollmer was eventually charged with third-degree assault for hitting N.E.
Defendant had received seven calls from concerned citizens about the girls and how they were being cared for by Vollmer but did little otf nothing in response.
Outcome: Plaintiffs' verdict for $4.1 million after three hours of deliberation by the jury.
