Description: Los Angeles, CA - Eduardo Cervantes sued Victor Cisneros and Paul Cruz on civil rights violation theories under 42 U.S.C. 1983 claiming that the Los Angeles County Deputies wrongfully ordered him to get out of his car and then attacked and injured him. Plaintiff claimed that he was setting in front of billiard hall on November 23, 2010 when he as approached and ordered to get out of his car by the deputies. He claimed that Deputy Cruz became angry when he asked what the reason was for the order by the officer. Cervantes elected to get out of his car and comply with the command that he face his vehicle and put his hands behind his back but was punched by Cisneros and was knocked backwards to the ground and suffered a head injury.
The defendants claimed that they were trying to cite Cervantes for having tinted windows in his car and that Cervantes began to struggle with them and threatened to spit on them. They charged Cervantes with resisting arrest but the charges were dropped.
Outcome: Plaintiff's verdict for $900,000.00.
