Description: Cedar Rapids, Linn County, Iowa - David Stutzman sued Cedar Rapids City Councilor Don Kerr on a slander theory claiming that by saying that Stutzman knew about pier-Built house in the Cedar Rapids area during a City Council meeting on October 25, 2011. Plaintiff claimed that Kerr's comments during the City Council meeting were malicious, reckless and untrue. The City Council voted to prohibit pier-bult homes without continuous frost-free foundations. Kerr said that Stutzman built a pier-built home in Linn County in 1998 without proper permits and was ordered to tear it down but it was destroyed by a fire before that could be done.
Kerr claimed that all of his comments were non-slanderous opinions and not statements of fact.
Outcome: Plaintiff's verdict for $140,000.00.
