Description: On October 6, 2012, while Plaintiff was a guest at Defendant’s hotel located at 400 E. Reno, in Oklahoma City, Oklahoma County, Oklahoma, she was injured when she fell, while walking down the staircase in the parking garage that the hotel directed her to use, that was not property lit. Plaintiff had to walk down the unlit stairs because the elevator would not take her to her floor. Due to Defendants’ negligence in failing to properly light the area, Plaintiff sustained bodily injury and suffered and will suffer pain, has incurred and will incur medical bills, suffered per[nanent injury and lost and will lose earning capacity.
Wherefore, Plaintiff prays judgment against Defendants in excess of the amount required for diversity jurisdiction pursuant to Section 1332 of Title 28 of the United States Code, plus costs, fees and all other appropriate relief
Outcome: Settled for an undisclosed sum and dismissed with prejudice.
