Damon Lamount Mathews, age 45, was accused for shooting and killing his wife Rachel Philips Mathews, age 47 on January 1, 2021.

Defendant claimed that he acted in the heat of passion, a lesser offense than first-degree murder.

degree are:
1. That the defendant,
2. in the State of Colorado, at or about the date and
place charged,
3. after deliberation, and with intent
a. to cause the death of a person other than
himself,
b. caused the death of Rachel Philips Mathews.
