The State of Colorado charged Kane Lee Klassen, age 33, with first-degree assault and battery and second-degree assault and battery as a result of a confrontation outside a Village Inn Restaurant at about 2 a.m. on July 4, 2012. He got into a fight with Daniel Marques, age 38, who was walking by the restaurant.

Defendant did not dispute that he hit the man with a rock but claimed self defense.
