Description: Davar and Todd Gardner sued John Stokes and KGEZ on a defamation theory claiming that Stokes made several false statements about them on the air after they filled a separate lawsuit against him in 2001 regarding property assessments. Stockes had claimed that he had an ownership interest in a 160-acre property owned by the Gardners upon which the radio station had erected two radio towers.
Stokes and the radio station claimed an easement over the entire 160-acres and further accused the Gardners to lying under oath during litigation over the claimed property rights and for submitting a false affidavit during the suit and committing bank fraud by obaining a $900,000 loan under false conditions.
Defendants asserted truth as their defense.
Outcome: Plaintiffs' verdict for $3.8 million.
