Defendant's Attorney: Jeffrey Owen Anderson

Description:

Dallas, Texas – Civil Litigation lawyer represented relator with a amended petition for writ of mandamus referring the parties to arbitration.

Entitlement to mandamus relief requires relator to show that the trial court
clearly abused its discretion and that she lacks an adequate appellate remedy. In re
Prudential Ins. Co., 148 S.W.3d 124, 135–36 (Tex. 2004) (orig. proceeding).
Based on our review of relator’s amended petition, appendix, and
supplemental appendices and real party’s response we conclude relator has failed
to demonstrate an entitlement to mandamus relief.

Outcome: Accordingly, we deny the amended petition for writ of mandamus. See TEX. R. APP. P. 52.8(a). We lift the stay issued by this Court’s August 26, 2021 order. We also deny relator’s motion to expedite the decision as moot.
