Description: Miami, Florida personal injury lawyer represented Plaintiff, who sued Defendants on civil rights violation theories under 42 USC 1983.

Susan Khoury claimed that she was injured and/or damaged as a direct result of being wrongly institutionalized for a psychological examination under the Baker Act, a state law that allows for involuntary emergency mental health services. She was in a dispute with residents who neighbored Glades Middle School in south Miami-Dade’s Sunset neighborhood and the patrons of the Glades Baseball and Softball League. People attended softball game at the fields maintained by the school parked illegally and left trash.

One person who parked illegally called the police because Khoury was taking pictures. Office Gregory Williams grabbed Khoury and twisted her arm dislocating her elbow. She was forced to the ground by Williams and an off duty officer who was also attending a game.

Williams asserted qualified immunity.
