Elbert Davis, Sr. and Phosa Cain were struck by an uninsured speeding driver on April 28, 2010. Davis was killed and Cain was severely injured.
The driver of the speeding car was being chased by three plainclothes Baltimore Police Department officers. The driver thought that he was being robbed and fled.
Burley ran a stop sign and struck the vehicle Davis was driving at the intersection of Gwynn Oak and Belle avenues.
The officers planted drugs in the car driven by Burley.
Outcome: Settled for $6 million and dismissed with prejudice.
