Description: Concord, New Hampshire criminal law lawyer represented Defendant charged with possession with intent to distribute fentanyl.

On September 30, 2020, a New Hampshire State Trooper stopped a vehicle in which Darvent Cummings, age 31, of Brooklyn, New York, was a passenger based on a traffic violation. The driver of the vehicle did not have a license and the driver and the defendant gave inconsistent stories about their travel itineraries. The driver was asked if there was anything illegal in the car and then started to cry. The driver eventually told the trooper that there were drugs in the car. A search of the car revealed two small bricks wrapped in duct tape, which later tested positive for more than 500 grams of fentanyl.

The case was investigated by the New Hampshire State Police with assistance from the Drug Enforcement Administration. The case is being prosecuted by Assistant U.S. Attorneys Seth R. Aframe and John J. Kennedy.

Outcome: Defendant was sentenced to 72 months in prison.
