In February 2021, law enforcement executed a search warrant on a residence where David Hueston, age 45, from Marion, Indiana, possessed over 2 pounds of methamphetamine and a firearm. Other items associated with drug distribution were found in the residence in addition to $17,000 cash and amounts of fentanyl, heroin and marijuana. Hueston is a convicted felon and, as such, was prohibited from possessing the firearm. 

This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives with the assistance of the Grant County Jean (Joint Effort Against Narcotics) Team Drug Task Force which is comprised of Grant County Sheriff’s Department and Marion Police Department. The case was prosecuted by Assistant United States Attorney Brent Ecenbarger.

21:841(a)(1) - POSSESSION WITH INTENT TO DISTRIBUTE A SCHEDULE II CONTROLLED SUBSTANCE, METHAMPHETAMINE, AND A SCHEDULE I CONTROLLED SUBSTANCE, HEROIN, AND FORFEITURE;

18:922(g)(1) - FELON IN POSSESSION OF A FIREARM AND FORFEITURE;
(2)

18:924(c) - POSSESSION OF A FIREARM IN FURTHERANCE OF A DRUG TRAFFICKING CRIME AND FORFEITURE.

Outcome: Defendant was sentenced to 240 months imprisonment consisting of 180 months on Count 2 to run concurrent to Count 1; 5 years supervised release to run concurrent to Count 1; and to pay $100.00 special assessment
