Description: Jackson received an electrical shock when he reached into a large walk-in beverage cooler to obtain a soft drink while a customer in Krupp's store. The shock caused Jackson to fall backwards into some metal shelves and onto the floor. As a result of the shock, Jackson sustained injuries which required surgery. Jackson sued alleging negligence. At close of evidence at the trial, Jackson's attorneys requested at least $1 million in compensatory damages.

Outcome: Jury returned a verdict in favor of Jackson and awarded him a total of $50,000 in compensatory damages.

Comments: Jackson appealed the inadequacy of the award and contended that the trial court should have granted his challenge for cause to an allegedly biased prospective juror. The Court of Civil Appeals of Alabama agreed (1 dissension) with Jackson and reversed the trial court and remanded for a new trial. See 727 So.2nd 82 (Ala.Civ.App.1997). Krupp appealed to The Supreme Court of Alabama which reversed and remanded the Civil Appeals Court ruling, reinstating the trial court judgment.
