Description: Covington, KY: Wire fraud and tax evasion criminal defense lawyer represented Kevin R. Welsch, age 48.

Welsch admitted defrauding clients of the debt collection business he owned and operated, RCC Services, Inc. Specifically, he admitted to collecting debts on behalf of creditors and keeping the money for his own use. He also admitted to collecting more than debtors owed (sometimes making multiple, unauthorized debits from their accounts) and charging his clients for fees/expenses that he never actually incurred. Finally, Welsch admitted evading taxes in the process.

Welsch pleaded guilty in May 2021.

Under federal law, Welsch must serve 85 percent of his prison sentence; and upon his release from prison, he will be under the supervision of the U.S. Probation Office for three years. Restitution has yet to be determined.

The investigation was conducted by the IRS CI, the FBI, and the Ft. Thomas Police Department. The United States was represented in the case by Assistant United States Attorney Elaine K. Leonhard.

Outcome: 09/02/2021 17 MINUTE ENTRY for SENTENCING as to Kevin R. Welsch held on 9/2/2021 before Judge Danny C. Reeves: Robert K. McBride appeared as APPOINTED CJA counsel of record. The Defendant appeared for sentencing and proceedings were held as noted. The PSR shall be filed in the record under seal. The Court adopted the findings and, except as noted, the guideline calculations set out in the PSR. The government's oral motion for a third-level reduction for acceptance credit was SUSTAINED. The parties objection for a two-level enhancement under USSG 3B1.3 was SUSTAINED. Defendant's oral motion for a downward departure and/or variance was DENIED for the reasons on the record. The parties shall file an Agreed Statement of Restitution within 7 days. If the parties cannot agree on the restitution amount relating to Count 1, the Court will schedule a hearing to determine the amount within 90 days. There were no objections to the sentence as stated or under the holding in United States v. Bostic. Transcript shall be deemed the written findings. Judgment shall be entered.
