This case was filed in the District Court in and for Tulsa County, case number CJ-21-02531, and was removed to federal court by Target.

On December 29, 2019, Plaintiff was an invitee of Defendant Target in its store at 10019 South Memorial Drive in Tulsa. While Plaintiff was walking into the store a Target employee was pushing a line of shopping carts on the sidewalk in front of the store. The employee lost control of the line of carts and several came lose and hit Plaintiff who was knocked to the ground and injured.

The elements of a personal injury claim are: (1) Failure on the part of the Defendant to exercise due care, (2) damages and/or injuries caused to Plaintiff, and (3) a direct casual relationship between 1 and 2.

Business owners owe a duty of due care in the maintenance and operation of their businesses to minimize the risk of injury or death to business invitees.
