Plaintiff claimed that she was wrongfully terminated because her gender, including discrimination on the basis of her being a homosexual and/or because she does not fit in the gender stereotype Defendant Putnam City School District has for females and retaliated against her when she complained of being discriminated against, in violation of Title VII of the Civil Rights Act of 1964 and Oklahoma's Anti-Discrimination Act.
The Defendant, Putman City School District employed at least fifteen employees for each of fifteen or more calendar weeks in the current or proceeding relevant calendar year and is an employer under Title VII. There is no minimum employee requirements to be subject to the provisions of the OADA.
Plaintiff was employed by Defendant starting in August 1998 and held the position and job title of Assistant Principal for which she was qualified and performed satisfactorily.
On about July 1, 2012, Fred Rhodes because Superintendent of the Putnam School District.
Rhodes made comments indicating he hold gender biases and gender stereotype including how females should dress including, but not limited to:
A. stating that he did not want females being principals in high schools within the school system and that he preferred to have males lead school with older male students;
B. Rhodes also indicated that he believed that marriage should be between a man and woman.
Plaintiff also alleged that Becky Gooch, a member of the school board, held gender stereotypes about females and about "gays" and/or "lesbians" being hired to leader positions in the school system.
Between May 2017 and May 2019, Plaintiff unsuccessfully made application for positions that would have been promotions.
Outcome: Settled for an undisclosed sum and dismissed with prejudice.
