Description: Medical negligence. Plaintiff, age 39, was injured in an automobile accident and taken to Defendant's hospital for treatment. A long operation to repair injuries sustained by Plaintiff was needed. At the end of the operation, the anesthesiologist extubated Mr. Payne. After he was transferred to an intensive care unit, his heart stopped beating for approximately three minutes. Payne suffered brain damage and was left in a persistent vegetative state.
Outcome: For Plaintiff against the hospital only for $7.6 million. (Plaintiff had settled with the anesthesiologist and the driver of the automobile which caused Mr. Payne's original injuries before trial.)
