Description: Tulsa, Oklahoma criminal defense lawyer representing Defendant charged with domestic assault and battery with a dangerous weapon in violation of 21 O.S. 644(D)(2), which provides:

"2. Any person who, without such cause, shoots an intimate partner or a family or household member as defined by Section 60.1 of Title 22 of the Oklahoma Statutes by means of any deadly weapon that is likely to produce death shall, upon conviction, be guilty of domestic assault and battery with a deadly weapon which shall be a felony punishable by imprisonment in the custody of the Department of Corrections not exceeding life. The provisions of Section 51.1 of this title shall apply to any second or subsequent conviction for a violation of this paragraph."

Jennifer Marie Kunzweiler, age 30, the daughter of Tulsa County District Attorney Steve Kunzweiler was also charged with plannning or threatening a violent act in violation of 21 O.S. 1378, which provides:

A. Any person who shall attempt, conspire or endeavor to perform an act of violence involving or intended to involve serious bodily harm or death of another person shall be guilty of a felony, punishable upon conviction thereof by imprisonment for a period of not more than ten (10) years.

B. Any person who shall threaten to perform an act of violence involving or intended to involve serious bodily harm or death of another person shall be guilty of a misdemeanor, punishable upon conviction thereof by imprisonment in the county jail for a period of not more than six (6) months.

C. Any person who shall devise any plan, scheme or program of action to cause serious bodily harm or death of another person with intent to perform such malicious act of violence, whether alone or by conspiring with others, shall be guilty of a felony, punishable upon conviction thereof by imprisonment for a period of not more than ten (10) years.

Ms. Kunzweiler is accused of stabbing her father twice while he was in the process of mowing his lawn.

Steve Kunzweiler reported that he had just returned home with his daughter from her therapy appointment and had gone outside to mow his yard when he saw her coming toward him with a large knife.

Ms. Kuzweiler has had had mental health issues for the past few years, and he said he heard her say "she needed to kill him."
