Description: Norman, Oklahoma personal injury car wreck lawyer represented Plaintiff, who sued Defendant on an negligence theory claiming to have suffered more than $10,000 in damages and/or injuries as a direct result of the death of Braden Elliot Carl. The action was based on the Oklahoma Survivor Statutes, 12 O.S. 1052, and the Oklahoma Wrongful Death Statute, 12 O.S. 1053.

Brand Carl owned a 2013 Hyundai Veloster with which he had numerous problems. It was worked on 13 times with Automax having possession and control over the vehicle for 162 days. Automax worked on the exhaust system on August 7, 2018. He died from carbon dioxide poisoning on October 22, 2018, as a direct result of an exhaust system leak.

Outcome: Settled for an undisclosed dum and dismissed with prejudice as to AutoMax.
