Description:
Wrongful death claim by the mother and estate of Jessi Spurlock, who was killed, when she was hit by a car driven by Brenna Wieker. Spurlock was walking along a residential street on her way to school. Cindy Van Wye, Jessi's mother, claimed that Wieker was negligent in the operation of her automobile. Spurlock and a friend were walking north on Village Way near Broadway Elementary School just after 7 a.m. when Spurlock was struck by a 1991 Jeep Cherokee driven by Wieker, who was 16 at the time. The girls had missed the bus and were walking back home to call for a ride. The plaintiffs claimed that Wieker was speeding and failed to keep a proper lookout.
The defendants claimed that Spurlock was walking in the middle of the street.
Outcome: Plaintiff's verdict for $284,000 with a finding that Spurlock was 27% at fault which will result in a $207,000 judgment against the defendants.
