Description: Dram Shop Act claim by couple were severely injured in a car-motorcycle accident on Delaware County Road 500-N. Thd Plaintiffs alleged that William J. Whitaker of Albany became intoxicated at a party celebrating the restaurant's grand opening on July 21, 1997. After leaving the opening, his car crossed the center line on County Road 500-N and collided nearly head-on with a motorcycle operated by David Markley. The Plaintiff further alleged that Outback served Whitaker, who was later convicted, of leaving the scene of the accident, alcohol for three hours free of charge.

Outcome: The jury ruled the couple deserved $60 million in damages, but also decided Outback should be held responsible for only 65 percent of that judgment.
