Description:

Urban Developers d/b/a Town Creek Apartments, owned by Shahid Shaikh sued the City of Jackson for condemning 95 units of his apartment complex without giving prior notice or an opportunity for a hearing and the Mississippi Regional Housing Authority VI for canceling a U.S. Housing and Urban Development contract to pay rent of low-income tenants at the complex.

The City claimed that it condemned the property because it was in a flood plain and flooded. The Housing Authority claimed that the contract was not renewed because the property had changed hands.

The Plaintiff claimed that the property flooded because the City did not maintain the creek channel adjacent to the property and that the HUD contract had been renewed after he bought the property and after the Housing Authority knew that he was the new owner for the property.

Outcome: Plaintiff's verdict for $450,000 against the City and $1 million against the Housing Authority.
