Description:
Patrick Fearing and Melody Fearing sued St. Paul Police Department, Jason Bain and David Stokes for the injuries and damages that they sustained as a direct result of Officers Bain and Stokes using excessive force in violation of 42 U.S.C. 1983 and Fearing's constitutional rights on New Year's Eve 2001. The officers responded to a call that Fearing was shooting off fireworks in his backyard. The Fearings claimed that the officers beat Mr. Fearing without just cause.
Outcome: Settled for $115,000 after a jury found in favor of the Fearings for $57,000 in July of 2005.
