Description:
Arnetta McCloud and other members of her family sued Kenneth W. Fortune and other members of the Leon County Sheriff's Department on a civil rights theory, 42 U.S.C. 1983, claiming that the defendants illegally detained and searched them in 2001.
The defendants, all former deputies or ranking offices, claimed that they ordered a "pat search" and that they were invited to search the home.
Arnetta McCloud claimed that she was stripped-searched and had her genitals scratched by a female deputy. Cynthia McCloud claimed that she was forced to pull down her pants by a female deputy.
Outcome: Plaintiffs' verdict for $2 million including $1.3 million in punitive damages.
