Case Style: Thomas Mundy v. Del Taco
Case Number:
Judge:
Court: Superior Court, Orange County, California
Plaintiff's Attorney:
Defendant's Attorney: Scott Ferrell, Call, Jensen & Ferrell, Newport Beach, California
Description: Thomas Mundy sued Del Taco on a civil rights violation theory claiming that he could not reach the soap or toilet-seat covers in the restaurant's men's restroom in Garden Grove. He claimed that his civil rights were violated.
Del Taco claimed that Plaintiff's claims were meritless and made by a professional plaintiff who intentionally and aggressively seeks out alleged ‘barriers,' which he never truly encountered. Mundy conceded during the trial that he had, in the words of the press release, "filed nearly 200 lawsuits in recent months, earning over $60,000 in settlements in 2008 alone."
Outcome: Defendant's verdict.
