Description: White Plains, NY - Mario Gomez, age 57, sued Jose Quinoys on a civil rights violation theory under 42 U.S.C. 1983 claiming that he was injured and damaged as a direct result of having been being "roughed up" at the Sleepy Hollow police headquarters where Quinoy was a detective in 2008.
Plaintiff called Quinoy abut his belief that Quinoy was having an affair with his daughter. Quinoy claimed that Gomez threatened him. Gomez went to the police station and during the confrontation between the two Gomez punched Quinoy in the face and was arrested and handcuffed and was thrown into a car and was hit and kicked in the head. The charges against Gomez were eventually dismissed.
Outcome: Plaintiffs' verdict for $1.05 million including $600,000 for Mario Gomez and $450,000 for AWilda Gomez. Plaintiffs' punitive damage claims were settled for undisclosed sums.
