In this insurance bad faith action, defendant Navigators Specialty Insurance
Company (Navigators) appeals from the order denying its special motion to strike under
California’s anti-SLAPP statute, Code of Civil Procedure section 425.16.1

In February 2017, appellant was driving in the northbound lane of the twolane state route 38 ("Rt. 38") just north of London, OH in Madison County. At the time,appellant driver's license was suspended. There were several vehicles ahead of him on
the road that afternoon and that section of the road featured a slight hill and curve. Appellant decided to pass the vehicles in front of him.

} On February 13, 2019, appellant was indicted on one count of aggravated
vehicular homicide in violation of R.C. 2903.06(A)(1)(a), a felony of the second degree, and
one count of operating a vehicle while under the influence (OVI) in violation of R.C.
4511.19(A)(1)(a), a misdemeanor of the first degree. The charges arose out of allegations

In the early hours of May 6, 2018, Fairfield Police Officer Matt Kellum was in his police cruiser, parked in the lot of Michael's Billiard, a pool hall that serves alcohol. Thepool hall was open, as was the nearby Rick's Tavern.

This is the second time this postconviction proceeding has been before us.
In Hull’s first appeal, we reversed and remanded finding res judicata did not bar Hull’s
postconviction claims.
