Call today if you think you have been injured or damaged by a defective product. Additional Information: Product liability law is a civil law doctrine that allows people to sue manufacturers and sellers for injuries caused by defective products:
Liability
Manufacturers, designers, sellers, and others in the supply chain can be held liable for damages caused by their products.
Defects
A product can be defective due to manufacturing, design, packaging, or a failure to warn.
Liability theories
Claims are usually based on negligence, breach of contract, or strict liability. Strict liability is the most common theory, and it allows plaintiffs to sue without proving negligence.
Damages
Victims can recover compensation for medical bills, lost wages, pain and suffering, and more. Punitive damages are also sometimes awarded, but they are rare and controversial.
Standards
Courts use two standards to determine if a product was defective: consumer expectation and risk-utility.
Jurisdiction
Different jurisdictions have different tests for product defects, and some states don't recognize strict liability
