Defendant's Attorney: Janice D. Lai

Description: New Haven, Connecticut slip and fall personal injury lawyer represented plaintiff, Renee Hoff, who sued Wal-Mart on a personal injury negligence theory claiming to have suffered more than $75,000 in injuries and/or damages in an accident in a Wal-Mart Store.

Outcome: 12/01/2020 10 ORDER. On November 10, 2020, defendants filed a notice of removal. (ECF No. 1). On November 12, 2020, after identifying jurisdictional defects in the pleadings, the Court ordered that "defendants shall file a statement on the docket adequately alleging the citizenship of the plaintiff and defendants Wal-Mart Stores East, LP and Wal-Mart Real Estate Business Trust" for the purpose of verifying the Court's jurisdiction no later than November 26, 2020. (ECF No. 9). Defendants were warned that the "[f]ailure to respond to this order or to adequately allege citizenship for the purposes of diversity jurisdiction as required by this order will result in a remand of this case for lack of subject matter jurisdiction." (Id.). To date, defendants have not responded to the Court's 9 order. As a result, the Clerk is directed to remand this action to state court and close the case.

Signed by Judge Michael P. Shea on 12/1/2020. (Super, John) (Entered: 12/01/2020)
