Description: Honolulu, Hawaii employment law lawyer represented the Plaintiffs who sued the Defendant on Fair Labor Standards Act violation theories.

"The Fair Labor Standards Act (FLSA) is a federal law that sets minimum wage, overtime pay, recordkeeping, and youth employment standards. The FLSA applies to most employers in the United States, including those who are self-employed.

Minimum wage

The FLSA requires employers to pay their employees at least the federal minimum wage. The current federal minimum wage is $7.25 per hour. However, some states and cities have higher minimum wages. If a state or city has a higher minimum wage than the federal minimum wage, then employers in that state or city must pay their employees the higher minimum wage.

Overtime pay

The FLSA requires employers to pay their employees overtime pay if they work more than 40 hours in a workweek. Overtime pay is equal to one and one-half times the employee's regular hourly rate.

Recordkeeping

The FLSA requires employers to keep certain records about their employees, including their hours worked, wages paid, and deductions made from wages. Employers must keep these records for at least three years.

Youth employment

The FLSA restricts the hours that minors can work and the types of jobs that they can do. For example, minors under the age of 16 cannot work in hazardous occupations.

Enforcement

The Wage and Hour Division of the U.S. Department of Labor enforces the FLSA. The Wage and Hour Division can investigate complaints of FLSA violations and can take enforcement action against employers who violate the law.

If you believe that your employer is violating the FLSA, you can file a complaint with the Wage and Hour Division. The Wage and Hour Division will investigate your complaint and take appropriate action if it finds that your employer has violated the law.

Here are some additional things to keep in mind about the FLSA:

The FLSA does not apply to all employers. Some employers, such as those who employ only family members or those who operate farms with fewer than 10 employees, are exempt from the FLSA.
The FLSA does not require employers to provide benefits such as health insurance or paid vacation.
The FLSA applies to both full-time and part-time employees."
