Texas is a “modified” comparative negligence state. Under the Texas modified comparative negligence standard, plaintiffs can sue for damages even if you are partially at fault for an accident. However, if a plaintiff is found to be more than 50% to blame for an accident, plaintiff cannot recover any damages.
