A jury convicted Walter Washington of second degree attempted murder after he shot and injured his girlfriend, Valerie Bryant, during a dispute in their apartment. At trial, Washington argued self-defense. The sole question presented is whether the court committed reversible error when it allowed the prosecutor to cross-examine Washington about his ability to leave the apartment when it later, at the defense's request, gave the jury an instruction that Washington had no duty to retreat.
