The Fair Labor Standards Act (FLSA) is a federal law that sets standards for wages, overtime, recordkeeping, and child labor for most private and public employees. The FLSA was enacted by Congress in 1938 to improve working conditions for employees. The Wage and Hour Division of the Department of Labor administers and enforces the FLSA.
Here are some of the FLSA's requirements:
Minimum wage: Employers must pay covered employees at least the federal minimum wage.
Overtime pay: Overtime pay must be one-and-a-half times the regular rate of pay.
Child labor: Children under 16 cannot work certain hours in nonagricultural operations, and children under 18 cannot work certain jobs that are considered too dangerous.
Recordkeeping: Employers must keep records of wage computations for two years. These records must be available for inspection by representatives of the Wage and Hour Division.
Some employees are exempt from the FLSA, including:
Computer workers whose salary is at least $684 per week or $27.63 per hour
Independent contractors and volunteers
Many full-time office workers, such as executives, administrators, and professionals
Outcome: Judgment in favor of the Plaintiffs.
