The Employee Retirement Income Security Act (ERISA) is a federal law that protects the retirement assets of American workers by establishing minimum standards for private sector retirement and health plans. ERISA was enacted in 1974 and is enforced by the Employee Benefits Security Administration (EBSA) of the U.S. Department of Labor.
ERISA requires plans to:
Provide participants with information about the plan, including funding and plan features
Set minimum standards for vesting, participation, benefit accrual, and funding
Establish a grievance and appeals process for participants
Hold fiduciaries accountable for their actions and decisions
Guarantee payment of certain benefits if a defined benefit plan is terminated
Outcome: This action is administratively terminated without prejudice to the rights of the parties to reopen for entry of any stipulation or order.
