Description:

San Diego, California Federal Tort Claims Act car wreck lawyers represented the Plaintiff.

The Federal Tort Claims Act (FTCA) is a federal law that allows private parties to sue the United States government for torts committed by federal employees:

What it does
The FTCA allows individuals to sue the government for personal injury, property damage, or death caused by a federal employee's negligence or wrongful act.

How it works
The FTCA allows the government to be sued in the same way as any other employer for its employees' negligence. However, the FTCA limits the government's liability in several ways, including not covering most intentional actions of employees and not allowing punitive damages.
When it was enacted
The FTCA was enacted in 1946.
Where to find it
The FTCA is found at 28 U.S.C. §§ 1346(b), §1402(b), §2401(b), and §§2671-2680.

To file a valid claim under the FTCA, a claimant must demonstrate that:

They were injured or their property was damaged by a federal employee

The employee was acting within the scope of their official duties
The employee was acting negligently or wrongfully
The negligent or wrongful act caused the injury or damage
