Description:

Miami, Florida Fair Labor Standards Act employment law lawyer represented the Plaintiff.

The Fair Labor Standards Act (FLSA) is a law that sets standards for wages, overtime pay, recordkeeping, and child labor for most private and public sector employees. The FLSA is administered by the Wage and Hour Division of the U.S. Department of Labor.

Here are some of the requirements of the FLSA:

Minimum wage: Employers must pay covered employees at least the federal minimum wage.

Overtime pay: Employers must pay covered employees overtime pay that is at least one-and-one-half times their regular rate of pay for all hours worked over 40 per week.

Recordkeeping: Employers must keep records of wage computations for two years. These records include time cards, wage rate tables, and work schedules.

Child labor: The FLSA restricts the hours that children under age 16 can work and prohibits the employment of children under age 18 in certain jobs.

Retaliation protections: The FLSA protects employees from retaliation.

The FLSA does not require employers to provide notice to employees before termination or lay-off. However, some states may have requirements for employee notification.
