Description:
Providence, Rhode Island Fair Labor Standards Act violation employment law lawyer represented the Plaintiff.
Ayame Hibachi is a Providence restaurant.
The Fair Labor Standards Act (FLSA) is a federal law that protects workers from unfair pay practices. The FLSA establishes minimum wage, overtime pay, recordkeeping, and child labor standards. The law applies to most private and public sector employees.
Violations of the FLSA can be addressed through civil or criminal sanctions:
Civil sanctions
The employer is liable for the violation and may be subject to injunctive relief to stop the violation.
Criminal sanctions
The employer may be subject to fines and imprisonment for willful violations.
The Department of Labor's Wage and Hour Division enforces the FLSA. If violations are found, the Department of Labor may:
Seek a settlement with the employer
File a lawsuit in a U.S. District Court
Restrain the shipment of goods produced in violation of the FLSA
Some common FLSA violations include:
Failing to record all hours worked
Misclassifying employees as exempt from overtime
Not paying employees at least the federal minimum wage
Not paying overtime at a rate of one-and-one-half times the regular rate of pay
Employing children in violation of the child labor restrictions
Outcome: Settled for an undisclosed sum and dismissed with prejudice.
