Connecticut's auto negligence law is based on modified comparative negligence, which means that an injured party can recover compensation if they are 50% or less at fault for an accident:

Compensation
If the plaintiff's fault is less than or equal to the defendant's, they can recover compensation, but the amount is reduced by the percentage of fault they share. For example, if the plaintiff is 30% responsible for an accident and requests a $100,000 settlement, they can only recover $70,000.

No compensation
If the plaintiff is more than 50% at fault, they cannot recover any compensation.
Evidence
Evidence used to determine fault includes weather, time of day, types of vehicles involved, witness reports, and photographs of the damage.
Filing a claim
Generally, you have two years to file a personal injury claim in Connecticut. However, notice periods for quasi-governmental agencies can be as short as 90 days.
Insurance
If you are found less than 50% at fault, you can file a claim with the other party's auto insurance carrier.
