The Fair Labor Standards Act (FLSA) protects workers from exploitation and ensures they are paid fairly for their work. Some common violations of the FLSA include:

Minimum wage violations: Paying employees less than the minimum wage, either state or federal

Overtime violations: Not paying eligible employees the correct overtime rate for hours worked over 40 in a week
Off-the-clock work: Requiring or allowing employees to work before or after their scheduled shifts or during meal and rest breaks without paying them for it
Improper deductions from pay: Making deductions from employees' paychecks that reduce their pay below minimum wage or overtime compensation
Misclassifying employees: Misclassifying employees as exempt from overtime pay
Child labor violations: Employing young people below the minimum working age required by state or federal law

Employers can violate the FLSA willfully or accidentally. Penalties for FLSA violations can be monetary, criminal, or civil. Willful violations of the FLSA may result in criminal prosecution and the violator fined up to $10,000. A second conviction may result in imprisonment.
