The Americans with Disabilities Act (ADA) is a civil rights law that prohibits discrimination against people with disabilities in many areas of public life. The ADA includes several key provisions that are important to know, including:
Reasonable accommodation
Employers must provide reasonable accommodations to qualified employees or applicants with disabilities, unless doing so would cause undue hardship. Reasonable accommodations can include making the workplace accessible, providing a reader or interpreter, or allowing telework.
Prohibited questions
Employers cannot ask job applicants about their disability or the nature or severity of their disability before making a job offer.
Penalties
The ADA provides for civil penalties of up to $50,000 for a first violation, and up to $100,000 for subsequent violations.
Enforcement
Different federal agencies enforce different parts of the ADA. For example, the U.S. Department of Justice enforces Title II, which covers public accommodations and state and local government services. The U.S. Department of Education enforces Title II for programs that receive federal financial assistance.
Definition of disability
The ADA defines a disability as a physical or mental impairment that substantially limits a person's major life activities. It also includes people who have a history or record of such an impairment, or who are perceived by others as having such an impairment.
