The Fair Labor Standards Act (FLSA) is a federal law that sets standards for wages, overtime, child labor, and recordkeeping for most private and public employees:
Minimum wage: Employers must pay covered employees at least the federal minimum wage.
Overtime pay: Covered employees must be paid overtime for hours worked over 40 in a workweek. Overtime pay is one-and-one-half times the employee's regular rate of pay.
Child labor: The FLSA restricts the hours children under 16 can work, and prohibits the employment of children under 18 in certain jobs.
Recordkeeping: The FLSA requires employers to keep records.
Enforcement: The Wage and Hour Division of the U.S. Department of Labor enforces the FLSA for private employment, state and local government employment, and some federal employees. Other agencies enforce the FLSA for other federal employees.
The FLSA also provides civil and criminal remedies, and allows employees to file private lawsuits.
Outcome: Settled for an undisclosed sum and dismissed with prejudice.
