Illinois uses a modified comparative negligence law to determine how much compensation an injured party can receive in a car accident:
Fault
The injured party can only recover damages if they are less than 50% at fault for the accident. If the injured party is 51% or more at fault, they cannot recover any compensation.
Compensation
If the injured party is less than 50% at fault, they can recover damages, but the amount will be reduced based on their percentage of fault. For example, if the injured party is 20% at fault and the total damages are $100,000, the injured party's compensation would be $80,000.
Evidence
To recover compensation, the injured party must provide clear evidence that the other party is primarily responsible. This evidence might include witness interviews, vehicle damage examination, or other evidence.
Some examples of negligent driving include:
Speeding
Running stop signs
Making illegal turns
Driving distracted
Driving under the influence of alcohol or drugs
Following too closely behind another vehicle
Not using a turn signal
Not using headlights at night
Outcome: Settled for an undisclosed sum and dismissed with prejudice.
