Here are some other things to know about product liability law in Illinois:

Negligence
In most product liability cases, the plaintiff must prove negligence. This means that the defendant was aware of the dangers of the product and didn't warn consumers, or that the defendant was careless in manufacturing or testing the product.
Misuse
Manufacturers and retailers are not liable if the injury was caused by misuse of the product.
Statute of limitations
Product liability actions must be brought within 12 years from the date of first sale, lease, or delivery of the product.
Duty to warn
A manufacturer has a duty to warn consumers if the product has dangerous propensities and the manufacturer knows or should know that harm may occur without a warning.
Jury determination
