The Fair Labor Standards Act (FLSA) of 1938 requires that nonexempt employees receive overtime pay for hours worked over 40 in a workweek:

Overtime rate
Overtime pay must be at least one and one-half times the employee's regular rate of pay
When to pay
Overtime pay is usually paid on the regular payday for the workweek in which it was earned
How to calculate
Overtime pay is calculated by multiplying the employee's straight time rate of pay by all overtime hours worked, plus half of the employee's regular rate of pay multiplied by all overtime hours worked

The FLSA also regulates child labor, restricting the hours children under 16 can work and prohibiting the employment of children under 18 in certain jobs.

Some exceptions to the FLSA's overtime requirements apply to police, firefighters, and employees of hospitals and nursing homes. The FLSA also does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, unless overtime is worked on those days.

The FLSA is administered by the Wage and Hour Division of the Department of Labor. Violating the FLSA can result in monetary penalties, litigation, and reputational damage.
