Defendant's Attorney: Liana De La Noval
Description:
Outcome: . This cause is before the Court on the parties' Joint Motion for Court Approval of Settlement Agreement and Request for Order of Dismissal with Prejudice (ECF No. 37). The Court has reviewed and considered the motion, the pertinent parts of the record, and the written settlement agreement between the parties, which was entered into by the parties after a settlement conference before the Court and follow-up negotiations and which was submitted to the Court for its in camera review. Pursuant to Lynn's Food Stores, Inc. v. United States, 679 F.2d 1350, 1353 (11th Cir. 1982), the Court finds that the parties' settlement of this action was achieved through representation of all parties by experienced counsel. The parties' settlement of these claims is the result of a bona fide compromise between them on a variety of disputes of law and fact. The settlement negotiated and reached by the parties reflects a reasonable compromise of the disputed issues. The Court also finds that the amount of the settlement that is designated as fees and costs for Plaintiff's counsel is reasonable. Therefore, the Court finds that the terms of the parties' agreement are fair and reasonable under the Fair Labor Standards Act. Accordingly, the settlement is APPROVED, the case is DISMISSED WITH PREJUDICE, and the case is now CLOSED. The Court will retain jurisdiction to enforce the parties' settlement agreement for 30 days.
