Description: Breach of contract claim by Zinc Corporation of America, a subsidiary of Horsehad Industries, against Tetra Tech, Inc. relating to cleanup efforts at and around a zinc smelter site located in Bartlesville, Oklahoma. The federal government mandated that Zinc Corporation cleanup heavy metals on a 28-acre plant site and surrounding neighborhoods. Plaintiff agreed to pay $17 million to Tetra to perform the cleanup work on the site. Tetra, however, submitted bills totaling $22.8 million. Smelting at the site started in 1907 and ended in the 1990s. Soil around at and around the site was contaminated with lead and cadmium, some of which was buried 20 feet deep. The U.S. Environmental Protection Agency and the Oklahoma Department of Environmental Quality ordered the cleanup in the 1990s.
Outcome: Verdict in favor of Zinc Corporation of America in the amount of $4.1 million.
