Description:
Pfizer, Inc. sued Teva Pharmaceutical Industries on a patent infringement theory claiming that Teva has been selling a generic version of Pfizer's Protonix since 1997. The original patent on Protonix, known chemically as pantoprazole, is held by Swiss drugmaker Nycomed [NYCMD.UL] and was licensed to Wyeth, which is now owned by Pfizer.

Teva claimed that the patent on Protonix was invalid on the theory that the chemistry of the drug was obvious.
Outcome:
Plaintiff's verdict on the issue of infringement only. Damages will be determined later.
