Description:
Bernadette Glynn, age 58, sued Merck & Co.'s subsidiary Merck Sharp & Dohme Corporation on a products liability theory claiming to have been injured and/or harmed as a direct result of taking Defendant's Fosamax osteoporosis treatment drug caused her femur to fracture spontaneously while she was gardening. She claimed that Defendant knew that Fosamax might cause brittle bones and increase the fracture risks for years before the drug was made available to the public.



Merck claimed that it provided doctors and consumers with appropriate and timely information about the drug manufactured and sold by it and taken by Plaintiff.



Plaintiff, an elementary school workers, regularly took Foxamax for seven years and suffered a femur fracture when she bent over to pick up an object in her garage in 2009.
