Description: Tulsa, OK - Sean Bryan Sullivan sued Bobby Custer and Mason Management, Inc. on auto negligence and respondeat superior theories.

The pre-trial order provided in part:

This is an action for damages resulting from an automobile accident that occurred on or about October 6, 2010, at or near the intersection of l4l Street and Barber Street in Glenpool, Oklahoma, in Tulsa County, State of Oklahoma. The Plaintiff was the driver of a 2009 Ford Ranger pickup truck and was traveling East on 141 Street. The Defendant, Bobby Custer, was driving a 2006 Chevrolet “box” truck owned by Mason Management, Inc., and was traveling South on Barber Street. The Plaintiff contends that the Defendant, Custer, negligently pulled onto 141st Street, from a stop sign regulating traffic on Barber Street, and into the path of the Plaintiff’s vehicle causing a collision. At the time of the accident, the Defendant, Custer was an employee of the Defendant, Mason Management, Inc., and was in the course and scope of his employment.

The Defendants asserted the following defenses:
